A recently formulated concept of stochastic localizability is shown to be consistent with a concept of stochastic microcausality, which avoids the conclusions of Hegerfeldt's no-go theorem as to the inconsistency of sharp localizability of quantum particles and Einstein causality. The proposed localizability on quantum space-time is shown to lead to strict asymptotic causality. For finite time evolutions, upper bounds on propagation to the exterior of stochastic light cones are derived which show that the resulting probabilities are too small to (...) be actually observable in a realistic context. This chapter deals with a crucial component of our position, the presumption that there are objective grounds for preferring one thing to another within the various cultural institutions we deal with, that there are better or worse symphonies, soufflés and theories of the atom. The task of showing this is more urgent for some institutions than others. While philosophers can doubt anything, most people are persuaded of the objectivity of our efforts to comprehend the physical world and to weigh, count (...) and measure accurately in many areas of human activity. Again, when we are faced with a choice among functional objects or processes, most people will admit that we can ground a preference for a knife or an exercise routine on objectively established facts: sharpness, or measurable increase in strength. Here, certainly, various conflicting desiderata may enter and make actual decisions more difficult — the sharpest knife may also be the most expensive; we may need to worry about its safety features; it may be ugly; and so on. But many will doubt that our judgements of comparative worth for non-functional objects such as paintings or sonatas can claim a similarly objective basis. We shall, therefore, concentrate our efforts on the most doubted areas, but will begin with the less contentious, where we think it is useful to draw attention to the genuine problems some philosophers have stressed, to show in fact that what we believe to be popular unconcern deserves to be somewhat ruffled. Langan believes that the writings of Merleau-Ponty "do not merely parallel roughly the three Kantian Critiques but... the development they reveal is impelled by the same internal necessity implicit in both philosophers' transcendental starting point." This interpretive scheme, like many sweeping generalizations sprinkled throughout the book, begs more questions than it solves. What exactly is the transcendental starting point? Does Merleau-Ponty believe that the claims of reason are wholly provisory and that "their value is essentially practical"? Does he make a (...) sharp distinction between the theoretical and the practical? If Langan believes that the two latter questions should be answered affirmatively, then his overall interpretation is downright misleading. Moreover, continual use is made of a whole battery of terms requiring clarification—e.g., "given," "dialectic," "ontological," "sense," "natural world." But Langan has captured much of the spirit of Merleau-Ponty's thought—especially in Chapter 2, "Incarnated Intentionality," a helpful, imaginative reconstruction of The Phenomenology of Perception. And in the last chapter he rightly attacks Merleau-Ponty for his vacillation between realistic and idealistic points of view. But, almost entirely on the basis of a few textual citations, Langan quickly pushes Merleau-Ponty into the idealist camp. If our critic is "convinced that although description from the transcendental viewpoint may invite disaster, it does not necessarily lead to it," then where did Merleau-Ponty make a wrong turn? A Non-Platonic Dualism in Aristotle's Lost WorksThe Soul of a Mortal on Earth is not "At Home," says Aristotle in his dialogue Eudemus. The story about the mantic dream of the expatriate Eudemus and his expectation that he "will return home"1 is well known. It makes clear that, in Aristotle's view, the death of the human (...) individual should be interpreted as the soul's "return to its homeland."2 This is strongly suggested by "the revelation of Silenus" which Plutarch (first century CE) passes down in a literal quotation from the Eudemus.3 It contains the theme of human life on earth as a punishment (timôria). The motif of human life as a punishment is central to two texts by Iamblichus (250-325 CE) and Augustine (354-430 CE), which are usually connected with Aristotle's Protrepticus.4 I want to examine these texts in more detail here. My intention in the following exposition is to propose a non-Platonistic explanation of these texts. In my opinion they have wrongly been read as testimonies of a "Platonistic" phase in Aristotle. The existence of such a phase in Aristotle's development has never been proved. Besides, the interpretation of these texts suffered from the fact that [End Page 289] Aristotle's De anima had also been explained in an unhistorical way since Alexander of Aphrodisias in the third century CE.2. Revising the Modern View of AristotleWe have to make a different assessment of Aristotle's contribution to the discussion on the soul compared with what was current until recently. For after W. Jaeger5 and F. Nuyens6, modern scholars became inclined to leave Aristotle's dialogues out of consideration, because they regarded them as "Platonizing." But a fundamental correction is necessary on this point.7 Jaeger led modern Aristotle studies in a wrong direction by assuming a sharp distinction between Aristotle's lost dialogue Eudemus and his surviving treatise De anima. Although nowadays Jaeger's theory for many scholars is something of a dead horse, nevertheless a real alternative has not been proposed. We still have to get rid of the consequences of the Jaegerian paradigm and develop a unitary interpretation of Aristotle's entire oeuvre. Even more consistently than O. Gigon has already done,8 we should assume that Aristotle's lost works and his surviving biological writings and De anima did not propose two (or more) different psychological theories but one and the same. Because this one Aristotelian psychology was a non-Platonistic but nevertheless dualistic psychology, we have much more reason than could be recognized in the past to assume Aristotelian influence on this discussion.On one essential issue Aristotle disagreed with his teacher Plato: the soul,9 more particularly the indissoluble bond of the soul with a body. Aristotle radically and [End Page 290] consistently argued for the distinction between nous and psychè.10 For Aristotle the nous-in-act is always wholly incorporeal. But he considered it characteristic of the soul that it cannot carry out its functions "without body."11However, the crucial question is: what body does Aristotle mean when he says that the soul cannot perform its specific activities "without body"? Jaeger and Nuyens were wholly convinced that Aristotle was referring to the visible, external body of a human being, animal, or plant. Hence they saw a yawning gap between Aristotle's views in De anima and his position in the dialogue the Eudemus. In the Eudemus Aristotle had clearly argued that the soul can perform its own functions very well, indeed better, without the galling and oppressive visible body.12 But in De anima II 1, in his famous definition of "the soul," Aristotle says that the soul is inextricably bound up with a "sôma physikon organikon."13 Jaeger and Nuyens, following an almost unanimous tradition since Alexander of Aphrodisias in the third century CE, interpreted this sentence in the sense that the soul is the formal principle or entelechy of an "organic body" or a "natural body equipped with organs," i.e., the visible body... Digeser contends that our rich and varied practices of friendship multiply and moderate connections to politics. Along the way, she sets forth a series of ideals that appreciates friendship's many forms and its dynamic relationship to individuality, citizenship, political and legal institutions, and international relations.

I adopt a cladistic view of species, and explore the possibility that there exists an equally valuable cladistic view of organismic traits. This suggestion seems to run counter to the stress on functional views of biological traits in recent work in philosophy and psychology. I show how the tension between these two views can be defused with a multilevel view of biological explanation. Despite the attractions of this compromise, I conclude that we must reject it, and adopt an essentially cladistic (...) conception of biological traits. (shrink)

Assuming it rational to treat other persons' probabilities as epistemically significant, how shall their judgements be weighted (Barnes [1998])? Several plausible methods exist, but theorems in classical psychometrics greatly reduce the importance of the problem. If scientists' judgements tend to be positively correlated, the difference between two randomly weighted composites shrinks as the number of judges rises. Since, for reasons such as representative coverage, minimizing bias, and avoiding elitism, we would rarely employ small numbers of judges (e.g. less than 10), (...) the difference between two weighting systems becomes negligible. Suggestions are made for quantifying verisimilitude, identifying 'types' of scientists or theories (taxometrics), inferring latent factors, and estimating reliability of pooled judgements. (shrink)

While researchers have examined the types of ethical issues that arise in long-term care, few studies have explored long-term care nurses’ experiences of moral distress and fewer still have examined responses to initial moral distress. Using an interpretive description approach, 15 nurses working in long-term care settings within one city in Canada were interviewed about their responses to experiences of initial moral distress, resources or supports they identified as helpful or potentially helpful in dealing with these situations, and factors that (...) hindered nurses in their responses. Using a thematic analysis process, three major themes were identified from the nurses’ experiences: (i) the context of the situation matters; (ii) the value of coming together as a team; and (iii) looking for outside direction. The work of responding to initial moral distress was more fruitful if opportunities existed to discuss conflicts with other team members and if managers supported nurses in moving their concerns forward through meetings or conversations with the team, physician, or family. Access to objective others and opportunities for education about ethics were also identified as important for dealing with value conflicts. (shrink)

The modal interpretation of quantum theory ascribes at each instant physical magnitudes with definite values to quantum systems. Starting from certain natural requirements, I determine unique solutions for the evolution of these possessed magnitudes in free systems and in special cases of interacting systems. The evolution is given in terms of transition probabilities that relate the values of the possessed magnitudes at one instant to the values at a second instant. I also determine a joint property ascription to a composite (...) system and its separate subsystems. Finally, I give a proof that the predictions of the modal interpretation with respect to measurement outcomes agree with the predictions of the standard interpretation. (shrink)

We analyse the relationship between applicability and effectiveness of legal norms from a philosophical perspective. In particular, we distinguish between two concepts of applicability. The external applicability of norms refers to institutional duties; a norm N is externally applicable if and only if a judge is legally obliged to apply N to some case c. Internal applicability refers instead to the sphere of validity of legal norms. A norm N is internally applicable to actions regulated by its sphere of validity. (...) We also explore the consequences of a thesis which maintains that applicability restricts the concept of effectiveness, so that only applicable norms can be considered effective. Our analysis illustrates that a proper reconstruction of the concept of applicability is of great importance not only for understanding the concept of effectiveness but also for providing insight into the nature of law. UK blood services, supported by the Health Protection Agency/Health Protection Scotland, carried out an exercise over the summer of 2005 to notify 110 donors whose blood was transfused to three recipients who later developed vCJD. These donors were to be informed that they were now considered 'at risk of vCJD for public health purposes'. The notification began on 20 July 2005 and was completed (barring follow-up) at the end of the first week of October 2005. Apart from two donors who (...) had died, contact was attempted with all donors, including four who were not currently registered with a GP. The lessons learnt about the conduct of such notification have been reviewed. The limited ad hoc feedback available suggests the process and content of this notification was acceptable to donors and their GPs. (shrink)

The widely cited Nuffield Council on Bioethics ‘Intervention Ladder’ structurally embodies the assumption that personal autonomy is maximized by non-intervention. Consequently, the Intervention Ladder encourages an extreme ‘negative liberty’ view of autonomy. Yet there are several alternative accounts of autonomy that are both arguably superior as accounts of autonomy and better suited to the issues facing public health ethics. We propose to replace the one-sided ladder, which has any intervention coming at a cost to autonomy, with a two-sided ‘Balanced Intervention (...) Ladder,’ where intervention can either enhance or diminish autonomy. We show that not only the alternative, richer accounts of autonomy but even Mill’s classic version of negative liberty puts some interventions on the positive side of the ladder. (shrink)
